Something to do with the AU classification board not giving games anything over a 15 certificate.  So it's technically not banned, it just can't be classified.

Exactly right. If it's unable to meet M15+ or under then it's rated RC (Refused Classification). It's illegal to sell an unclassified game in Australia, and recently they began cracking down on game importers as well.
All this is held back because of one politician in South Australia. For some reason our senate needs a 100% affirmative vote to pass the law and add the classification. So literally it's down to one man who refuses to vote for it.
His reasoning is that parents in Australia pay no attention to ratings as it is, so letting in games which are more adult than existing games would only make matters worse.
And the stupid thing is that I actually agree with him. As stupid as the lack of an R18 game is, nobody follows it anyway. Buying adult rated games for kids is one of my pet hates. In Australia, it literally ruins it for the rest of us.
EDIT: My theory is the fact limbs can be dismembered. They have strict rules and circumstances when it comes to that. No game is allowed to dismember limbs from a living character or after they've died (as in shooting a dead body to chop it up). The only time limbs can be removed is during the process of killing the character.

In CoD:WaW can't you shoot up a dead body with a light machine gun and dismember it?
I know it can be done to living charcters, but I don't remember if it can be done with dead ones.

He's an ignorant moron who can't understand that people have a freedom to choose. Legally, no, I couldn't purchase these R-rated games (although don't think that would stop me...), but when I come of age, as a proud gamer, I don't want to be living in a country that denies my culture as abhorrent, or something to be ashamed of. What I am ashamed of, is the way the higher powers in this country sp frequently reject gaming, and those who place it in high esteem as an activity, as lesser to their precious routined and constricting lives.
What I'm ashamed of is the fact that such ignorant people can be assigned such influential roles.
