headset communicator mike won't allow me to talk, need help

Just got my 360, bought used. The headset plays voices through the ear, but not able to send my voice. Checked for the flashy speaker next to my name on Halo 2, none
No one can hear me
When I press the team chat button, I hear the com turn on and then off a second later, just like it would if everthing was working and I didn't say anything.

Bought a brand new comm from joytech and the exact same situation occurs so I tried my other controller, same thing so figuring it's not a hardware issue. Do I need to try something else? Are there settings I need to check? I made sure my voice output settings are corect and theres no parental control setup.
Seached google and this forum and another, no real reference to a problem like this. Pretty frustrated can someone please help me?

SO frustrating trying to play halo with no mike and on the new 360 controller,
and I'm drill sarg in my clan

Played a while no mike, figured I'd try it again and plugged in the comm and vwalah

it works perfectly absolutely no rhyme or reason

Did you switch the mic on? lol

Push the 360 button on the controller, go to Personal Settings, and make sure that mute is not selected
