I would contact Microsoft and tell them the console is scratching discs and you haven't moved it at all since you bought it, tell them how's its mounted currently and the symptoms. Tell them you want it fixed under warranty, they'll ask you to register it with them first, tell them where you got it.. if you got it from an e-store on ebay, give them the name of the e-store, if from a seller, tell them you bought it online.

Most companies will only honor a warranty if the item is purchased from authorized dealer, and guess what? ebay is not.. nor are any of the sellers on ebay. This applies to almost any warranty from any company with just about any item.

..but it doesn't hurt to try

Thanks Makmillion, i only bought the xbox 360 less than a month ago, the guy who i bought it from said i could have had the receipt but him and his friends xbox 360 purchase is on it and his friend wanted it just in case, he said this when i picked it up locally (at his house) if i managed to get the receipt off of him temporarily would i be able to take it back to the store he bought it from and say i bought it instead and ask for a replacement console? Would the fact that two xboxes were bought at the same time (his, which is now mine, and also his friends) matter? I understand there is a 1 year warranty here in the UK for the xbox 360 does that make only Microsoft liable or the shop he bought it from as well or both?

LOL, if you can manage to get that receipt do it. You want to know what I think about that guy? He knew full well his machine was scratching discs, and he scammed you. Can you check anywhere on the machine to show you when it was manufactured? I doubt he ever had any intention of giving you the receipt... Honest people don't change the terms when you show up to close the deal.

Have you tried your system in the vertical position. Ive read in some places its recommended this way...
Ive always had mine this way and my discs seem fine....

No he didn't mention the receipt in the listing he just offered that information when i was in his house, i didn't even ask (stupidly) about the receipt so i don't know if he is a scammer or not, he would be pretty stupid if he was cuz i know where he lives and i only live a 25 mins drive from him, but yeah he probably knew his xbox 360 scratched discs as i got a disc read error only a few days into buying it I've emailed him about it hours ago but he hasn't replied yet. The console was manufactured in March 06' he said at the time he bought it in June 06' and has hardly played it, i don't know how that disc got so many scratches though which he gave with console, i didn't even look until i got disc read error Btw i haven't once moved the console and it has made some unhealthy gurgling sounds recently while playing, thats what prompted me to take the disc out of the drive and look at it, i usually leave the same disc in which has recently been scratched, as i like to complete one game at a time. I've only played a maximum of 3 hours in one session and probably only 3 times a week over the past 4 weeks i have owned the console.
